WILLARD CITY CORPORATION ORDINANCE NO. 2016-C
AN EMERGENCY SPECIAL ORDER FOR WILLARD CITY IMPOSING SPECIAL FIRE AND FIREWORKS RESTRICTIONS WITHIN THE CITY LIMITS BEGINNING June 23, 2016, UNTIL SEPTEMBER 15, 2016.
WHEREAS,
the City of Willard (hereafter
referred to as the “City”) is an incorporated municipality duly existing under the laws of the
state of Utah; and,
WHEREAS,
Utah Code Annotated
§10-8-84, 1953, as amended, grants municipalities broad authority to provide for safety and preserve health, and promote prosperity, improve morals, peace and good order, comfort, convenience, and for the protection of property; and
WHEREAS,
due to current and forecasted weather conditions coupled with the extremely dry conditions in northern Utah; and
WHEREAS,
Utah Code Annotated
§15A-5-202.5 (1)(c)(1) 1953, states "When the fire code official determines that hazardous environmental conditions necessitate controlled use of any ignition source, including fireworks, lighters, matches, sky lanterns, and smoking materials, the following may occur: If the hazardous environmental conditions exist in a municipality, the legislative body of the municipality may prohibit the ignition or use of an ignition source in mountainous, brush-covered, or forest-covered areas or the wildland urban interface area, which means the line, area, or zone where structures or other human development meet or intermingle with undeveloped wildland or land being used for an agricultural purpose; and,
WHEREAS,
The Willard City Fire Official has determined such conditions exist within the municipality on the east side of Highway 89 (Main Street) in Willard City eastward to the east City Limits.
NOW, THEREFORE
, be it ordained by the City Council of Willard that: In effect immediately until
SEPTEMBER 15, 2016
for the area east of Highway 89 (Main Street) eastward to the east City limits: The following restrictions are in effect for the above described area: 1. Setting, building, maintaining, attending or using open fires of any kind, except campfires built within the facilities provided for them in permanently improved places of habitation. 2. Discharging, or using any kind of fireworks, tracer ammunition or other pyrotechnic devices including explosive targets 3. Cutting, welding, or grinding metal in areas of dry vegetation. The following persons are exempted from the above prohibitions: 1. Persons with a permit specifically authorizing the prohibited act at a specific location. 2. Any State or Federal Fire Officer or firefighting forces in the performance of an official duty. Violation of the above prohibited acts is punishable as a class B misdemeanor.
Effective Date.
This Ordinance shall be effective immediately after posting and shall remain In effect until September 15, 2016 unless rescinded earlier by the Willard City Council. PASSED AND ADOPTED by the City Council on this day 23
